Terms of Service

These terms govern how you use Assay — the website, the API and the $14.99 PDF valuation report we sell through it. By placing an order or using the service you agree to them. They're written in plain language; the legal force is the same.

Current product Assay today sells a single product: a $14.99 USD valuation PDF report, delivered by email. The iOS app and marketplace features described in some sections below are in development and are not currently available.

01Who we are, what Assay is

"Assay" (we, us, our) is operated by Benjamin Rosenberg, a sole trader in the United Kingdom. We currently operate the website at assayapp.net and the API at api.assayapp.net, through which we sell a single product: a $14.99 USD branded PDF valuation report delivered by email.

An iOS app and a two-sided marketplace are in development. References in these terms to the app, in-app subscriptions, or marketplace transactions describe features that are not yet live; those sections take effect when the corresponding feature ships.

"You" means the person using Assay — whether you're requesting a valuation, buying a report, or simply browsing.

02Eligibility

  • You must be at least 13 years old to use Assay, and at least 18 to enter into a transaction or subscribe to a paid plan.
  • You must have legal capacity to enter into a contract in your jurisdiction.
  • You must not be on a sanctions list or located in a sanctioned territory.
  • You may not use Assay on behalf of someone else without their authorisation.

03Your account

Purchasing a report automatically creates an account, keyed to the email address you check out with. You can also create one directly via Sign in with Apple. You're responsible for keeping your credentials secure and for everything done from your account. Tell us at [email protected] immediately if you suspect unauthorised access.

One account per person. We can suspend or close accounts that are duplicates, automated, or used to abuse the service.

04What Assay does

Assay generates a market-based valuation for collectible items based on blended data from external sources (sold-price databases, grading services, registries, live marketplace listings) and sells a $14.99 USD branded PDF report capturing that valuation for a single item. The estimate is a band, not a guarantee.

Reports include a signatory page allowing a credentialed ISA, AAA or ASA appraiser to countersign for USPAP-compliant scheduling (for example for insurance, probate or customs purposes). Without that countersignature, the Assay report is a market-based valuation document and not a USPAP appraisal.

Important — not financial advice, not an appraisal Assay valuations are informational. They are not investment advice, an appraisal under any regulated scheme, or a guarantee of resale value. Collectibles can fall as well as rise; do your own research before making purchase or sale decisions. Where a USPAP-compliant appraisal is required (insurance scheduling, probate, customs, donation), use the report's signatory page with a credentialed appraiser or commission a separate certified appraisal.

05The Assay Report

When you order a report you receive:

  • A branded PDF report for the item you submitted — cover page, headline valuation with confidence band, source breakdown, comparable sales, methodology notes, watermark and signatory page.
  • A copy delivered by email to the address you checked out with, plus a copy archived to the account auto-created against that email.
  • A 7-day re-delivery window: if the email doesn't arrive, request a fresh send from [email protected] within 7 days of purchase and we will re-deliver at no charge.

Refunds and your right to cancel

The report is a digital good delivered immediately on purchase. At checkout you must tick a box confirming you want delivery to begin immediately and that you accept this waives your statutory 14-day cancellation right under the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, regulation 37 (and the equivalent EU consumer-rights regime). If you do not tick that box, we cannot generate the report.

Beyond that statutory position, we will refund a purchase in full if: (a) the report was never delivered and re-delivery has failed; (b) the report contains an obvious data error attributable to us; or (c) we agree at our discretion that a refund is fair. Email [email protected] within 30 days of purchase.

06Pricing

The Assay valuation report is a single SKU at $14.99 USD per item. Payment is taken at checkout. The price you see is the price you pay — there are no add-ons, no buyer's premium, no listing fees.

  • Payment is processed via Stripe Checkout. Your card statement will show the descriptor ASSAY VALUATION.
  • VAT is not currently charged on this product. We are a UK sole trader operating below the £90,000 VAT registration threshold; we will register for VAT and add it to invoices once we cross that threshold, with notice to customers.
  • We may change pricing going forward. Any price change applies only to orders placed after the change takes effect.

07Payment processor

Card payments for the report are processed by Stripe Payments UK, Ltd. Stripe's own terms and privacy policy apply to your card data. Assay never sees your full card number, expiry or CVC — we receive only a payment confirmation and the limited metadata Stripe forwards to us (last 4 digits, card brand, country) so we can reconcile orders and handle refunds.

We do not currently work with any escrow, KYC or third-party authentication partners. Those integrations are planned for the marketplace, which is in development.

08Acceptable use

You agree not to:

  • Scrape, mirror, or systematically download valuations or report content outside the rate limits we publish.
  • Attempt to reverse-engineer the valuation model or breach the security of our infrastructure.
  • Misrepresent items, identity, or the purpose of a valuation request.
  • Use Assay to launder funds, evade taxes, evade sanctions, or fund illegal activity.
  • Upload content that is unlawful, infringing, abusive, or contains malware.
  • Resell, redistribute or relicense reports without our written permission, or resell access to our API without a commercial agreement.

09Intellectual property

The Assay name, the Hallmark Shield mark, the website, the API, the report template and the valuation methodology are our intellectual property. When you buy a report you receive a personal, non-exclusive, non-transferable, revocable licence to use that report for your own purposes (including sharing with your appraiser, insurer or executor). You retain ownership of any item details, photos and descriptions you submit, but grant us a worldwide, royalty-free licence to use that content as needed to generate, deliver and store your report and to improve the valuation model.

10Suspension and termination

We may suspend or close your account if you breach these terms, abuse the service, or are required to do so by law. You can close your account at any time by emailing [email protected]. Closure does not entitle you to a refund of previously delivered reports. Reports already issued remain valid and yours to use.

11Warranties and liability

The service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that valuations are accurate, that the service will be uninterrupted, or that defects will be corrected.

We do not exclude or limit liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any liability that cannot lawfully be excluded under the consumer-protection laws of your jurisdiction.

Subject to that, our aggregate liability for any claim arising from your use of Assay is limited to the greater of: the fees you paid us in the 12 months preceding the claim, or £100.

12Changes to the service or these terms

Assay is actively developed. Features may be added, changed, or removed. We may update these terms; if the changes are material, we'll post the update here with a new effective date and notify customers at least 14 days in advance by email. Continuing to use Assay after the effective date means you accept the updated terms.

13Governing law and disputes

These terms are governed by the laws of England and Wales. Disputes will be heard in the English courts, except where mandatory consumer-protection law gives you the right to bring proceedings in your country of residence.

Before going to court, please email [email protected] and we will work in good faith to resolve the dispute directly.

14Apple-specific terms (iOS)

When the Assay iOS app ships, the following applies: these terms are between you and Assay, not Apple. Apple is not responsible for the app or its content, and Apple has no obligation to provide maintenance and support. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price to you (if applicable); Apple has no other warranty obligation. Apple is a third-party beneficiary of these terms and may enforce them against you with respect to your use of the app.
